  • The type of visa that must be applied for is called a K visa (or fiancé visa). This type of documentation allows entry into the U.S. for both the fiancé and his or her children. However, this is a temporary visa that is only valid for 90 days.
  • Qualifications for a K visa include (1) the U.S. citizen having met the fiancé within the past two years; and (2) having documented proof (such as letters, emails, pictures, airline tickets) that there is an actual relationship.
  • Since there is a limited amount of time during which the fiancé can remain in the country on the K visa, there must be intent to marry during this time. The fiancé is required to leave if he or she does not marry the citizen during the 90 day time frame.
