Massachusetts L1 Visa Attorney
When a foreign company wants to operate in the United States, the L-1 visa may be necessary. Common goals are to open a U.S. subsidiary, or to carry out a specific project that requires "specialized knowledge."
L-1A: The L-1A Non-Immigrant Visa is used by "executive/managerial" personnel who wish to establish a business here. It can be valid from one to three years. If the executive is coming to the United States to establish the business, USCIS usually only grants them a one (1) year visa to start with. Once the company is established and viable, the company can apply for a three-year extension of the L1A non-immigrant visa upon a showing that there is a continuing relationship between the U.S. subsidiary, foreign business and the applicant.
L-1B: The L-1B is for workers with "specialized knowledge" who will remain temporarily, and perform a more distinct task. For example, foreign employees needed to train workers at the U.S. operation are appropriate candidates for the L-1B.
Requirements
Criteria for L-1 Visa (Intra-Company Transferees):
- Individual must be continuously employed abroad for one of the past three years by a parent, affiliate or subsidiary of the U.S. company immediately preceding the application.
- Individual desires to enter U.S. for a temporary managerial, executive, or specialized role position.
- In some situations, this visa may be converted to permanent residency.
