Massachusetts TN Visa Lawyer
Each category of visas exists to serve a particular need or purpose. NAFTA, the North American Free Trade Agreement, is a treaty created in the 1990s to increase trade and cooperation between the United States, Mexico and Canada. TN business visas facilitate this trade.
The TN visa is intended for business people such as finance and accounting, engineering, and management professionals. As the list changes frequently, contact us for a current list of eligible professionals.
Nonimmigrant Visa
Like other employment visas, the TN visa allows you to bring your spouse and children. However, TN visas are nonimmigrant visas. If your purpose is to remain in the U.S. you should apply for a different kind of visa. Other visa categories are "dual intent" visas. For example, the H-1B is a work visa, but you are permitted to pursue permanent residency through another means while you are in the United States on your H1B non-immigrant visa.
You should indicate that your work in the U.S. is not planned to be indefinite. If it appears you wish to remain, your TN visa application will be denied.
Qualification
Aside from Mexican or Canadian citizenship and job skills, a job offer from an American company may be required. Part-time work is acceptable. Mexican and Canadian company employees being transferred to a U.S. company that is the parent, or a branch, subsidiary or affiliate are good candidates.
Application
Our law firm can help you prepare the best possible application. This is important, because denials are not uncommon. Applicants in Canada do not have to apply at the U.S. embassy, but Mexican applicants do. Processing time is between two and three weeks and the visas are good for two years. They can be renewed with no limitation.
